The United Nations confirmed that privacy remains a human right in the digital age, but our daily digital experiences and seemingly ever-increasing amounts of data suggest that privacy is a mundane, distributed and technologically mediated concept. This article explores privacy by mapping out different legal and conceptual approaches to privacy protection in the context of datafication. It provides an essential starting point to explore the entwinement of technological, ethical and regulatory dynamics. It clarifies why each of the presented approaches emphasises (...) particular aspects and analyses the tensions that arise. The resulting overview provides insight into the main strengths and limitations of the different approaches arising from specific traditions. This analytic overview therefore serves as a key resource to analyse the usefulness of the approaches in the context of the increasing datafication of both private and public spheres.Specifically, we contrast the approach focusing on data subjects whose data are being ‘protected’ with others, including Fair Information Practice Principles, the German right to ‘informational self-determination’, and the South American ‘habeas data’ doctrine. We also present and contrast emerging approaches to privacy and discuss their intersection with datafication. In conclusion, we put forth that rather than aiming for one single solution that works worldwide and across all situations, it is essential to identify synergies and stumbling blocks between the various regulatory settings and newly emerging approaches. In this expanded version of the original symposium, to which Professor Dray has provided a critical response, a group of prominent philosophers and historians address the central questions posed by contemporary philosophy of history - such as, the logic and methodology of historical explanation, the selection and uses of evidence, the (...) fact/value relationship, the nature of historical causation, the question of conflicting interpretations and their possible resolution, the idea of history as a school of practical wisdom, and the question whether history has any discernable pattern or meaning. These issues are approached from the experience of both historians and philosophers and represent an important increment to the long-standing and continuing debates concerning the nature and aims of the practice and philosophy of history. Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. Cet article est le premier d’une série de contributions dont l’objectif est de rendre compte des investigations menées à Délos sur les différents secteurs de la ville qui n’ont jusqu’à présent fait l’objet d’aucune fouille. Celui‑ci est consacré à la région située au nord et à l’est du stade, au contact de la presqu’île de Patinioti. Il ressort des observations réalisées en surface du terrain naturel qu’on a affaire à un quartier d’habitations organisé en îlots autour d’une voie principale nord-sud, (...) qui semble être la continuité du quartier du Stade fouillé par A. Plassart et pourrait dater de la seconde période de la domination athénienne après 167 av. J.‑C. Sur les franges littorales est et ouest, les maisons sont construites perpendiculairement à la ligne du rivage, obligeant les constructeurs à réaliser d’importants travaux de génie civil. Les différences structurelles observées entre ces deux systèmes conduisent à se poser la question de la chronologie relative qui a présidé au développement de ce secteur. (shrink)

Le renouvellement des notions d’historicité et de spatialité est au cœur des préoccupations de la philosophie contemporaine. De l’appel nietzschéen à cultiver la faculté de l’oubli pour mieux affronter un présent sans contexte jusqu’à la critique radicale de la dialectique historique par les philosophies de l’événement, en passant par la durée chez Bergson et par les développements de la phénoménologie relatifs à l’espace et au temps vécus opposés à l’espace tridimensionnel et au temps chronologique, dans tous ces cas il s’agit (...) de redéfinir la tâche de la pensée en découvrant de nouvelles potentialités au temps et à l’espace et en accordant un statut nouveau à l’historicité et à la spatialité. En situant ces notions au centre du débat contemporain, J. Benoist et F. Merlini prolongent un travail déjà amorcé avec Après la fin de l’histoire. Temps, monde, historicité. Cette fois, l’heure est moins au constat de la fin du modèle de l’Histoire, qu’à une interrogation en direction d’une nouvelle forme de pensée dominée par le paradigme géographique. Plus précisément, et tel que l’indique son sous-titre, ce recueil de textes analyse la thèse singulière, propre à une partie de la philosophie contemporaine, d’un renversement du rapport de subordination entre l’histoire et la géographie. L’exergue tiré d’un texte de Foucault donne déjà le ton au livre: «L’époque actuelle serait peut-être plutôt celle de l’espace». Les auteurs interrogent donc les sources et les ressources d’une pensée qui a rompu avec la fétichisation de l’histoire, dans sa version dialectique ou ontologique. L’une des grandes originalités du livre dirigé par Jocelyn Benoist et Fabio Merlini consiste à placer sous une même enseigne des penseurs provenant d’horizons aussi lointains que l’architecture, l’urbanisme, le structuralisme et la sociologie, pour en faire à chaque fois les représentants de la «crise de l’historicité» et du «déclin de l’histoire et de la tradition spéculative». Les auteurs espèrent ainsi contribuer au développement d’un modèle géographique ou cartographique de la pensée à caractère non plus spéculatif, mais descriptif du réel. L’ancien impératif platonicien «Nul n’entre ici s’il n’est géomètre» cède en quelque sorte sa place à un nouvel adage: «Nul n’entre ici s’il n’est géographe»! (shrink)

TOPOGRAPHICAL MISSIONS ΤΟ LATO I (2005-2007): A CRITICAL ANALYSIS OF THE PLAN BY J. DEMARGNE AND V. SEYK (1901) In the years 2005 and 2007 the site of Lato in Crete was the object of three new topographical and geomorphological study campaigns. The works carried out over the entire site permitted in particular the analysis of the only to date available complete plan of the city, that of J. Demargne and the architect V. Seyk undertaken in 1900. The objectif was (...) to establish its documentary interest and limits in use, and thus better prepare new measurements and guide renewed field work. To do this, it was first necessary (I) to retrace the history of previous graphic documentation, (II) to analyse the work of J. Demargne and V. Seyk, so as (III) to gauge its value against the standards of current research, and (IV) to establish its interest in terms of the cultural resource management of the site. A second paper to appear in BCH will develop, on basis of a new documentation, the urban and morphological analysis of the remains of Lato. (shrink)

Une loi de Delphes du Ile siècle apr. J.-C. montre que la cité procéda à l'époque impériale à deux lotissements successifs de terres sur une partie de son territoire. On a supposé que la région lotie pouvait être le plateau de Desphina dans le massif du Kirphis. Cette déduction tirée du texte peut-elle être confirmée par l'examen du terrain? Le présent article tente d'apporter une réponse, qui intéresse à la fois l'histoire de Delphes et la méthode de la recherche sur (...) les cadastres antiques. Pour trouver les vestiges d'un parcellaire fossile on a recherché les trames orthogonales sur un orthophotoplan, puis tenté lors d'une prospection au sol d'identifier, voire de dater les lignes ainsi visibles. La méthode appliquée suivant des critères et des limites expressément définis ne permet pas, en toute rigueur, d'affirmer l'existence de vestiges matériels d'un lotissement antique de terres sur le plateau de Desphina. An Indian Court recently awarded 50,000 rupees damages to a couple who gave birth to their fourth daughter. The couple were mistakenly told they were carrying a male fetus. The doctor mistook a section of the umbilical cord for a penis. The husband said: “We are already struggling to raise three children. This was a big sacrifice for us to have a fourth child. We would have had an abortion if we had known it was a girl”. The cost of (...) damages amounted to the dowry they would have to pay at the time of their daughter's marriage.This is a fictional case. But the cases of Nicholas Perruche and Lionel1 are not fictional. According to reports, damages were paid to these children on the basis of what the media has described as a “right not to be born”. Is there a “right not to be born?” Was it right to compensate Nicholas Perruche for being born with congenital rubella and Lionel for being born with Down's syndrome?HARM TO THE CHILDWhat constitutes a right is a complex question. On one interpretation, rights protect interests. This implies that a right not to be born would exist if a child had an interest in not being born. Is it ever in a child's interests not to have been born? If it were, this might imply the child is better off dead than alive, as the Collective against Handiphobia claim. Is it better to be dead than have Down's syndrome?Some people do believe that Down's syndrome constitutes a life not worth living.2 But this view seems false. Children with Down's syndrome can and often do lead happy and worthwhile lives. After all, we do not suggest that other animals have a right not to be born or a life not worth …. (shrink)

Tarn's conclusion, however, was soon challenged by Professor Lionel Pearson, who disagreed in particular with Tarn's interpretation of the passage in Strabo. But, although he undoubtedly succeeds in showing that some of Tarn's arguments are not valid, Pearson fails, as it seems to (...) me, to disprove his main contention. Although histories of cognitive behaviour therapy have begun to appear, their use with people with psychosis diagnoses has received relatively little attention. In this article, we elucidate the conditions of possibility for the emergence of cognitive behaviour therapy for psychosis (CBTp) in England between 1982 and 2002. We present an analysis of policy documents, research publications and books, participant observation, and interviews with a group of leading researchers and senior policy actors. Informed by Derksen and Beaulieu’s articulation of social (...) technologies, we show how CBTp was developed and stabilised through the work of a variety of overlapping informal, academic, clinical, professional, and policy networks. The profession of clinical psychology played a key role in this development, successfully challenging the traditional ‘division of labour’ where psychologists focused on ‘neurosis’ and left ‘psychosis’ to psychiatry. Following Abbott's systems approach to professions, we identify a number of historical factors that created a jurisdictional vulnerability for psychiatry while strengthening the jurisdictional legitimacy of clinical psychology in providing psychological therapies to service users with psychosis diagnoses. The National Institute for Health and Clinical Excellence played a significant role in adjudicating jurisdictional legitimacy, and its 2002 schizophrenia guidelines, recommending the use of psychological therapies, marked a radical departure from the psychiatric consensus. Our analysis may be of wider interest in its focus on social technologies in a context of jurisdictional contestation. We discuss the implications of our study for the field of mental health and for the relationship between clinical psychology and psychiatry. (shrink)

This is implied by the claim of andre gide's which walker misinterprets. The issue of natural desires in (...) contrast to artificial desires introduces the question of 'authenticity', Which is looked at in connection with lionel trilling's "sincerity and authenticity". Herbert Lionel Adolphus Hart was born in Yorkshire in 1907 to second generation Jewish immigrants. Having won a scholarship to Oxford University, he went on to become the most famous legal philosopher of the twentieth century. From 1932-40 H.L.A Hart practised as a barrister in London. He was pronounced physically unfit for military service in 1940, and was recruited by MI5, where he worked until 1945. During his time at the Bar he had continued to study philosophy and at (...) M15 his interest was further stimulated by his philosopher colleagues in M16, Stuart Hampshire and Gilbert Ryle. After the war, Hart returned to Oxford to take up a philosophy fellowship, later to become Professor of Jurisprudence. H.L.A Hart single-handedly reinvented the philosophy of law and influenced the nation's thinking in the 1960s on abortion, the legalization of homosexuality, and on capital punishment. Hart's approach to legal philosophy was at once disarmingly simple and breathtakingly ambitious, combining as it did the insights of Austin and Bentham and the new linguistic philosophy of J.L. Austin and Ludwig Wittgenstein. He sought to elucidate a concept of law which would be of relevance to all forms of law, wherever or whenever they arose: his bestselling book, The Concept of Law, has sold tens of thousands of copies worldwide. In 1941, he married Jenifer Williams (a high-ranking civil servant, later an Oxford academic) with whom he had four children. Their relationship was an enduring if unconventional one. In the early 1950s, Jenifer was rumoured to be having a long-standing affair with Isaiah Berlin, one of Hart's closest friends. She was also, falsely, accused by the Sunday Times of having been a Russian spy, an allegation which was all the more scandalous given Hart's position at MI5 during the War. Nicola Lacey draws on Hart's previously unpublished diaries and letters to reveal a complex inner life. Outwardly successful, Hart was in fact tormented by doubts about his intellectual abilities, his sexual identity and his capacity to form close relationships. Her biography also sheds fascinating light on the origins of his ideas, and assesses his overall contribution. Above all, it chronicles of a life which had a depth ands impact far greater than many of Hart's readers have realized. (shrink)

Žižek is not clear-headed; doesn't understand Kierkegaard; doesn't understand Lenin; or is too much of a soft-hearted liberal who only wishes he weren't. Žižek fears liberalism may threaten freedom. But the threats he sees — although real — are old news to liberals. Lionel Trilling-inspired hints concerning (...) the proper care and feedings of the liberal imagination conclude the paper. Ils essayent plutôt d'entendre " l'héritage de la puissance " à laquelle la littérature comme phénomène semble nous engager, en retraçant un chemin dont les haltes se situent au cœur de la méditation agambenienne sur notre époque : l'avènement possible d'un sujet qui descendrait d'une " puissance pure ", irréductible à l'identification, dépouillé de toute substance, (...) sinon du mouvement par lequel il s'approprie lui-même en tant que puissance sans objet. Chacun des auteurs tente ainsi de potentialiser certaines propositions d'Agamben à partir de ce qu'on appelle " littérature ". Comment, à l'heure où celle-ci semble faire l'épreuve d'une neutralisation de son destin historique, penser sa relation au temps messianique? Au moment où plusieurs œuvres se vouent au recueillement de l'innommé, de l'insignifiant et des heures mortes comme au seul territoire qui leur serait préservé, comment penser l'articulation philologique entre le reste et la résistance? Pourrait-on conférer à la littérature un statut d'exception politique, voire de zone d'anomie constitutive du politique? These remarks consider Andrew Fiala’s Tyranny from Trump to Plato in the context of political apathy and climate pessimism. First, I raise the issue of whether or not some form of tyranny might be necessary in dealing with the crisis of climate change. Second, I express some skepticism about Fiala’s dual remedies of moral education (Ch 8) and constitutional wisdom (Ch 9) to face our present political challenges.

Are interpersonal comparisons of desire possible? Can we give an account of how facts about desires are grounded that underpins such comparisons? This paper supposes the answer to the first question is yes, and provides an account of the nature of desire that explains how this is so. The account is a modification of the interpretationist metaphysics of representation that the author has recently been developing. The modification is to allow phenomenological affective valence into the “base facts” on which correct (...) interpretation is grounded. To use this extra resource within that theory to vindicate interpersonal comparisons, we will need to appeal rational connections between level of valence and level of desire, which this paper sets out and examines.
